Power Plays : It’s not About Win or Lose, its About How You Play The Game

Latest in the Kulbhushan Jadhav case, The International Court of Justice has held Pakistan guilty of violating the Vienna convention and ruled in favor of India. As a result, Pakistan granted consular access to Kulbhushan Jadhav on 02 Sep 2019. Although India had sent a message to Pakistan making clear that the consular access must be unimpeded, however the access came with certain conditions. Finally after much ado, the meeting was held between Indian deputy higher commissioner Gaurav Ahluwalia and Kulbhushan Jadhav in the presence of a Pakistan official at a sub-jail on 02 sep. After the two hour long meeting ,Ahluwalia said that Jadhav appeared under extreme pressure to parrot a false narrative to bolster Pakistan’s untenable claims.

When Jadhav was sentenced to death by Pakistan Military court in 2017, it was very apparent that the court was a farcical court where the people involved in decision making were not even having law degrees. Not even a copy of the order was made public as that would have revealed that neither the Pak government had any facts nor was the decision reasoned out at all. This goes to show that none of the judicial bodies in Pakistan can be trusted as all of these courts are very likely to be controlled by Military leaders of Pakistan.

During 2017,when India first approached the ICJ and made its submission of the case, Pakistan government rejected at least five requests for consular access to Jadhav. It took the Pakistan Government over seven months to grant sanction to Jadhav’s family members to vis him. When they finally did, the overall atmosphere of the meeting was intimidating and they were not made to feel welcome. Jadhav’s  mother and wife were forced to change their clothes and were not allowed to speak in their mother tongue. His wife’s Mangalsutra and Bindi were seen to be as weapons of mass destruction which needed to be confiscated. And as if that wasn’t enough, both of them were asked to remove their shoes, never to get them back. Such act of indecent behavior with women speaks volumes about a nations values and has already put Pakistan to shame on an international platform. 

Facing a severe defeat from India on the Kashmir issue after abrogation of article 370, Pakistan ‘s next game plan is to approach the ICJ on Kashmir matters. Whether the ICJ entertains its case or not is up to them to decide, but what Pakistan must keep in mind is that it should tread very carefully along the dangerous mine field that it has now laid for itself.

With increasing isolation of Pakistan in the international community, it has already lost all credibility on  the hue and cry it raised for Kashmir and with its continued arrogant attitude, it might just lose the hold on Jadhav case as well.

With no international backing and the US administration pulling hundreds of millions of dollars in funding from Pakistan military, they should be very careful of their next step as it could lead to disastrous results. As such the relations between the two countries have forever been sour on the Kashmir issue, the last thing to increase tensions between the two nations will be the Kulbhushan Jadhav case. Pakistan should give a serious thought to the repercussions of any action it takes as even a single wrong step would open the doors to destabilizing retaliations from India with consequences that could spiral out of control.

In such a scenario, it seems like a better option to channelize all their aggression and energy into building a better nation for themselves.
